Learned Counsel for the parties submits that the dispute has been amicably settled and, accordingly, they have filed Consent Terms before the Appeal Court in an appeal arising out of interlocutory proceedings in the present Admiralty Suit. It is agreed between the parties that the Consent Terms filed in the appeal should be treated as Consent Terms in the suit and on the basis of the same terms, the suit should be disposed of.

Accordingly, copy of the Consent Terms tendered in the Appeal Court is marked as "X" for identification. The statements and undertakings contained therein are accepted and the suit is disposed of in terms of the Consent Terms. There shall be no order as to costs. Refund of Court fees in accordance with the applicable rules.
