The learned counsel for the petitioner submits that the petitioners have assailed the notice under Section 148 of the Income Tax Act. However, subsequently, final assessment order avk 1/2
214-WP-2657-2008-215-WP-2658-2008.doc was passed. The same was assailed before the Commissioner (Appeals) and the Commissioner (Appeals) has given relief to the petitioner. The Tribunal has not thereafter assailed the said order. The learned counsel for the petitioner, as such, states that nothing survives for adjudication in the present matters and seeks leave to withdraw the writ petitions.
Mr.Malhotra, the learned counsel for the respondents, is present.
In view of the aforesaid reasons, writ petitions are disposed of as withdrawn. No costs.
