Learned Counsel for the parties have tendered Consent Terms dated 22nd December, 2017 by which it stated that the parties have amicably resolved their dispute. The Consent Terms are signed by

2/2 903-coms.825.2017 the plaintiff as also Defendant No.1-Mr.Dilip Jena, the sole proprietor. The Consent terms are also signed on behalf of Defendant No.2. The Advocates for the respective parties have also initialed the Consent Terms. There is no dispute with regard to the signatures as appearing on the Consent Terms. Accordingly, the Consent Terms dated 22nd December, 2017 are taken on record and marked 'X' for identification. The undertakings as given by the parties in the Consent Terms stand accepted.

The Suit is accordingly disposed of in terms of the Consent Terms. Refund of Court Fees, if any, as per the Rules. 3.

In view of the disposal of the Suit, Notice of Motion No.741 of 2017, does not survive and same stands disposed of accordingly.
