There is an ad-interim order dated 21st October 2016 passed after notice. I gave time till 18th November 2016 to file Reply. There is no Affidavit in Reply nor have the Defendants entered appearance.

There is an Affidavit of Service dated 5th December 2016 of one Mr. Krishna Kadam, a Clerk in the employment of Mr. Mahesh Mahadgut, Advocate for the Plaintiffs. In this, he states that the packet with the documents in question was sent by speed post and that the tracking report shows delivery of the packet. The Affidavit is taken on file.

In view of this, and for the reasons set out in the order dated 21st October 2016, it is confirmed as the final order on the Notice of Motion.

The Notice of Motion is made absolute in these terms with costs. In addition, the Plaintiffs will be entitled to recover the actual costs of the Notice of Motion at the time of final hearing of the Notice of Motion.
