Learned Counsel for the defendants states that this chamber summons has been filed by the alleged constituted attorney of the executor and is thus not maintainable on that ground itself.
2] In view of this objection raised by the learned Counsel
YBG 32-cst-119-18 for the defendants, the learned Counsel for the applicant seeks liberty to withdraw this chamber summons with further liberty to file a fresh chamber summons and states that the said chamber summons would be filed by the Executor himself. Statement accepted. Chamber summons is allowed to be withdrawn with liberty as prayed. All contentions on merits of chamber summons that would be filed by the applicant are kept open.
