Pursuant to the orders passed by this Court dated 25 th and 26 th October, 2016, Defendant No.1 has now handed over the suit flat to the Plaintiffs and has issued possession letter dated 25-11-2016 to the Plaintiffs. Defendant No.1 has also issued a receipt to the Plaintiffs acknowledging payment of the balance consideration of Rs.1.49 Crores. Copies of possession letter as well as receipt acknowledging payment of Rs.1.49 Crores are taken on record. In view thereof, nothing survives in the Suit and the Suit is therefore, disposed of as infructous. Refund of Court Fees if any as per rules.
