The Testamentary Suit, which arises out of Testamentary Petition No.377 of 2004, was dismissed by an order dated 16 February 2015. By an order dated 25 January 2017, passed in Notice of Motion No.2 of 2016, the suit was restored to file. The present Notice of Motion was taken out simultaneously for restoration of the petition. Through oversight that Notice of Motion was not disposed of. The Motion is accordingly disposed of by restoring the Testamentary Petition.
