1] The appeal is filed challenging the impugned order dated 27th September 2016. In terms of this order, if the admitted amounts due to the petitioner in the company petition is not paid within four weeks from the date of the order, then the proceedings for admission and advertisement would commence. Before expiry of four weeks, the appellant (respondent company before the learned Single Judge) is before this court in the first week of October 2016. 2] Representatives of the parties are present. Now both the parties have settled their differences amongst themselves and consent terms are placed on record, the same is marked as 'X' (for the purpose of identification). A demand draft for a sum of Rs.13,77,773/- is handed over to the respondent by the appellant and the same is accepted by the respondent. The appeal is disposed of in terms of the consent terms.

4] The amount towards advertisement deposited by the respondent / petitioner is permitted to be withdrawn.
