Heard the learned counsel for the applicant.
The address of the respondent-assessee mentioned in the cause title of the appeal is the same as the address mentioned by the respondent-assessee in the appeal preferred by him before the Appellate Tribunal. In view of the assertions made in the affidavit in support and in particular paragraphs 3 to 5, it appears to us that notice could not be served in ordinary way at the address mentioned by the respondent before the Appellate Tribunal. Hence, the Chamber Summons is made absolute in terms of

We make it clear that the cost of the public notice published in terms of prayer clause (a) shall be borne and paid by the applicant. Registry to fix appropriate returnable date for notice.
