Heard the learned Advocates appearing for the parties and the following order is passed by consent :

i.

The disputes and differences arising out of the Franchisee Agreement dated 14th July, 2011 between the parties are referred to the sole Arbitration of Mr. Justice S.P. Kurdukar, (Former Judge of Supreme Court of India).

ii. The learned Arbitrator shall endeavour to pass his Award within a period of six months from the date of the first meeting held by him with the parties and their Advocates.

iii. The parties shall appear before the learned Arbitrator in his chambers, on 13th February, 2015 at 5.00 p.m. and obtain necessary directions.

Nitin 987-ARBAP-353-2014 iv. The cost of arbitration shall initially be borne by the parties equally. v. All contentions of the parties are kept open. vi. The venue of Arbitration shall be at Mumbai. The above Arbitration Application is accordingly disposed of. (S.J. KATHAWALLA, J.)
