There is no dispute that the arbitration agreement exists between the parties under the agreement dated 18th April, 2012. 2.

By consent Mr.Devvrath Singh, advocate having his address 22/43, First Floor, Rajabahadur Mansion, Tamarind Lane, Fort, Mumbai - 400 001 is appointed as the sole arbitrator. 3.

It is made clear that as and when any claims are filed before the learned arbitrator, if according to the respondent any of the claims are not arbitrable or beyond the scope of arbitration agreement, such issue of arbitrability can be raised before the learned arbitrator. The issue of arbitrability of such claim is kept open. 4.

The arbitration application is disposed of in aforesaid terms. No order as to costs.
