Mr. Joshi, learned senior counsel appearing of the petitioner states that in view of the averments made by the respondent in paragraph 34 of the reply dated 17th April,2015, this petition has become infructous and seeks liberty to withdraw this petition. Respondent has raised an issue of maintainability of this petition in this court.

In view of the statement made by the learned senior counsel for the petitioner, I do not propose to go into the issue whether this petition could have been at all filed in this court in view of the fact that the seat of the arbitration was at Singapore and thus Part I of the Arbitration and Conciliation Act, 1996 would not apply in the facts of this case. Petition is dismissed as withdrawn with the clarification made aforesaid.
