The Advocate for the petitioner submits that, they already filed Appeal before the Debt Recovery

2/3 Appellate Tribunal and preferred application for stay of the order dated 21st November, 2017. He submits that, as the date for taking physical possession of the suit property is postponed by the respondent, he received instructions from his client to withdraw the present petition with liberty to move before the Debt Recovery Appellate Tribunal for appropriate orders.

The Learned Counsel for the petitioner, has given in writing, that he received instructions from his client to withdraw the present Writ Petition with liberty to move the DRAT in pending Appeal. The same is taken on record and marked 'X' for identification. The same is accepted.

At this stage, Learned Counsel Mr. Dubey, appearing on behalf of respondent no.1 makes a statement that, for next 15 days they are not going to take any steps for taking possession. Statement is

(A) The Writ Petition stands disposed off as withdrawn with liberty as prayed for.

(B) No order as to costs.

(C) Mr. Dubey, submits that, he undertakes to file his Vakalatnama during the course of the day. Statement is accepted.
