Having heard both sides and finding that there is sufficient cause shown for setting aside the conditional order passed by the Prothonotary and Senior Master under Rule 986 of the Bombay High Court (Original Side) Rules, 1980, the notice of motion is made absolute in terms of prayer clause (a). The order of the Prothonotary and Senior Master is set aside on the condition that all compliances shall be made with the requirements in the Bombay High Court (Original Side) Rules, 1980. One of the compliances is that this court should be satisfied that the appeal is filed within time. Since it is conceded that the appeal is filed within time, the Registry shall not raise the issue of time bar or limitation. Let the compliance with other requirements with the Rules be made within a period of three weeks from today and thereafter, the Registry shall register this appeal and place it for admission.
