The parties agree that the evidence in Suit No.103 of 2015 on the preliminary issues framed under section 9-A of the Code of Civil Procedure, 1908 shall be treated as and deemed to be evidence on the preliminary issues framed under section 9-A of the Code of Civil Procedure, 1908 in Suit No.2363 of 2012. It is also clarified that 1/2

901-nms1845-17 the evidence of the defendant no.1 and his cross-examination in Suit No.103 of 2015 shall also be treated as and deemed to be evidence in Suit No.2363 of 2012.

The notice of motion is disposed of in aforesaid terms. No order as to costs.
