The Petitioner claims that his provident fund dues have not been paid to him fully. According to him, he had submitted his claim as per representation dated 13th February, 2015 (Exhibit "C") before Respondent No. 1 but till date the same has not been considered and decided.

The learned counsel for Respondent No. 2 submits that some amount is still unpaid which needs adjudication. 3.

Thus, we find that the Petitioner's claim needs to be adjudicated by the Competent Authority keeping in view Section Vishal Parekar 1/2

26-wp-2621-2016.doc 7A(b) of the Employees' Provident Fund and Miscellaneous Provisions Act, 1952.

Keeping in view the aforesaid, we are inclined to dispose of this Petition by directing Respondent No. 1 to consider the Petitioner's claim as per his representation (Exhibit "C") and decide it in accordance with law after giving due opportunity of hearing to the Petitioner and Respondent No. 2. Let the decision as aforesaid be taken as expeditiously as possible.
