Plaintiff versus Twinkle Star Co-op. Housing Soc. Ltd. ...

Defendant Ms. Supriya B. Gurav i/by Mr. Sachin Bandkar, for Plaintiff. Mr. Sudalai Mani i/by M/s. Mahesh Menon and Co., for Defendant. Mr. Saji Jose, Chairman of Defendant present. CORAM: S.J. KATHAWALLA, J.

DATE: 8 th MARCH, 2018 P.C.:

1.

The learned Advocates for the parties have tendered Consent Terms dated th March, 2018. They submit that the Consent Terms be taken on record and the above Suit be disposed of in terms of the Consent Terms. 2.

A perusal of the Consent Terms gave me an impression that the Consent Terms are collusive in nature. I therefore, inquired from the Chairman of the Defendant Society if there is any collusion involved between the parties. He has assured the Court that there is no collusion involved in the matter and infact, the General Body has passed a Resolution to the effect that the Society has no right or claim whatsoever on Plot No.G bearing CTS No.1550 and have no objection for the deletion of the name of the Defendant Society from the records of the Plot No.G bearing CTS No.1550.
