By consent of parties, the impugned award dated 9th July 2015 is set aside. The disputes between the parties are referred to the sole arbitration of Mr. Shyam Kapadia, Advocate. The Arbitrator shall carry on the hearing of the reference from the point of time at which it was left, i.e., on 13th June 2013. The arbitration reference shall be concluded as expeditiously as possible and in any event, within four months from today.

The Petitioner shall pay his share of the costs occasioned in the earlier arbitration reference and which have been borne by the Respondent alone. To that end, the Petitioner shall pay a sum of Rs. 2,00,000/- to the Respondent within a period of two weeks from today.

The Petition is disposed of accordingly.
