The Petition proposes the adoption of a female minor Sapna, born on 11th March 2009, by two Italian nationals. Sapna was found abandoned by the New Delhi Railway Police Station. She was presented before the Child Welfare Committee, New Delhi. Sapna apparently told the police that she and her family stayed in Mumbai but being of tender years she was unable to give any proper details
about the families address. She was transferred to the Additional Observation Home in Chembur. She was then transferred to the Petitioner institution on 16th June 2014.

Since then her age verification has been completed. Newspaper publications and television advertisements have been issued. None have come forward to claim her. Sapna has been declared legally free for adoption.

I have carefully considered the Petition and its accompanying papers. They are in order. The undertaking and Affidavit by the Petitioner institution is on file. The no objection certificate from CARA is also on record.

The adoptive parents are Italian aged 46 and 42 years respectively. They have no children of their own. Their health reports are in order. The adoptive father is a music teacher. The adoptive mother is a teacher in a primary school. Their combined income is sufficient and their income tax and financial documents are also on record. The child care arrangement plan by the adoptive mother states that she will not go to work for six months so as to look after Sapna. After that, her grandmother will take care of the minor. The couple also plans to keep a part-time servant to look after other household chores.

The home study report is entirely positive. It reports that the couple are aware of their limitations but are also able to provide well
for a minor born before 6th January 2015 but not older than 7 years and 11 months. The minor Sapna fits the criteria. 6.
The medical examination report of the minor shows no negative or adverse circumstances. Quite understandably, she requires personal attention. She is sociable. She has a slight deformity of the left elbow. The proposed adopters have countersigned the report. The HIV report of the minor is also negative. The undertakings, declaration of consent and willingness of the adoptive parents are on record.

The scrutiny report filed by Mr. O. Hareendran, Scrutiny Officer of the ICSW is taken on record and marked "X" for identification. He also submits a progress report of the minor from the public school in Chembur. She has got several certificates and her progress is satisfactory. The compilation is taken on record and marked "X1" for identification.

In view of this, the Petition is allowed and the Judge's Order is separately signed.
