This Leave Petition was originally filed in 2014 prior to the lodging of Summary Suit (L) No. 304 of 2014. It seems that the Summary Suit was dismissed for non-removal of office objections and Leave Petition did not survive. The Summary Suit has since been restored to file and along with it the present Leave Petition. 2.

The Summary Suit is for recovery of an amount due under tax invoices of the goods sold and delivered. The Defendant has its registered office outside Mumbai. The invoices were payable in Mumbai. A material part of the cause of action having arisen within 14th March 2017
