Parties have tendered draft minutes or order dated 30th October 2018 which is taken on record and marked "X" for identification. Order in terms of the minutes or order.

All insolvency proceedings including Official Assignee's Report dated 26th February 2014 stands disposed.

Mr. Shah for petitioning creditor and Mr. Mishra for respondent no.5 state that they will pay a sum of Rs.10,000/- each as costs to the office of Official Assignee within one week from today. Statement accepted. Official Assignee may utilise this money towards office administrative expenses.

6/7 Mr. Shah states that the advocate on record Mr. Divyakant Mehta shall file an affidavit confirming that he has instructions from petitioning creditor to apply for amendment of the plaint as per the draft annexed to the draft minutes of order. Mr. Shah states that the affidavit will

7/7 be filed within one week from today. Statement accepted. Amendment to be carried out and copy of the amended plaint to be served within three weeks from today.

Official Assignee to return the original passport to respondent no.5 - Mr. Dileepkumar P. Ranglani.

Summary suit no.148 of 1994 is restored to file. Mr. Mishra states that he shall file Vakalatnama on behalf of defendant no.2 in the summary suit under advise to plaintiff's advocates within three weeks from today. The statement of plaintiff that they shall take out summons for judgment within four weeks from today is accepted. If plaintiff has taken refund of court fees, then that amount has to be deposited with Prothonotary and Senior Master within six weeks from today. (K.R. SHRIRAM, J.)
