The arbitration petition is dismissed as withdrawn with liberty as prayed subject to the appointment of the learned arbitrator which is passed by consent of both parties. It is made clear that this Court has not expressed any opinion on the merits of the matter. All the rights and contentions of the parties are kept open. No order as to costs.
