3. In view of the above, the arrest order dated 7th October, 2015 stands vacated and Defendant No.1 i.e. Cargo of 24,000 M.T. of cement is released from arrest.

4. Advocate for the Plaintiff has taken search of CAVEAT AGAINST RELEASE BOOK and found that there is no caveat filed against release of Defendant No.1.

5. Mr. Sumit Valecha, the proprietor of the Plaintiff undertakes to pay the poundage within the period of one (1) week from today.

6. In view of the above, Admiralty Suit (L) No. 1042 of 2015 is disposed off.

7. Refund of court fees as per rules.

8. All parties, including the Port Custom and other authorities are to act on an authenticated copy of this order.
