Counsel for appellant states that leave to withdraw the appeal be granted with liberty to appellant to approach the trial court with an interim application to amend the plaint. Mr. Kadantot states that if, appellant takes out any such interim application, respondents will certainly oppose the same, if so advised.

Therefore, appeal dismissed as withdrawn with liberty as prayed for. Should such an application for leave to amend the plaint is taken, the trial court will consider the same on merits and after hearing respondents, who are defendants in the suit.
