This arbitration petition seeks interim protection in respect of a property at Goa, which is claimed to be a partnership property. The arbitration petition is essentially between the partners of a firm by the name of M/s. Kanaka & Associates, who is Respondent No.4 to the present petition. The application seeks interim relief against the Corporation of the City of Panaji Goa restraining the latter from sanctioning and regularising development of the partnership property at Goa. It is claimed that the firm of M/s. Kanaka & Associates has applied for this development through Respondent No.1 herein. It is the case of the Petitioner that this application is filed without his authority or consent.

Learned Counsel for the Petitioner tenders an order passed Pg 1 of 2

arbp1194-16.doc by the Corporation of the City of Panaji Goa dated 25 April 2017. By this order, the application of the partnership firm of M/s. Kanaka & Associates, filed through its Architects, for sanction and regularisation of development, has been rejected. Learned Counsel places a copy of the order on record and submits that the petition has, thus, become infructuous and is not pressed. The copy of the order passed by the Corporation of City of Panaji Goa on 25 April 2017, is taken on record, marked "X" for identification. The petition is disposed of as not pressed. No order as to costs.
