Learned Advocate for the Defendants have written instructions to make a statement that the Defendant has ceased use of the impugned mark "CITRUS" in respect of the business of a hair dressing and beauty salon. The statement is accepted as an undertaking to the Court.

I note that the Defendants are in the process of re-branding their outlet. They must ensure that during this exercise they do not even by accident mention that their outlet was formerly known as

909-NMSL2775-15.DOC "CITRUS" and is now acquiring a new name. Mr. Khan accepts this and makes a statement to this effect too. This is also accepted as an undertaking to the Court.

These statements having been accepted, nothing survives in either the Notice of Motion or the Suit.
