Heard the learned Advocates appearing for the parties and the following order is passed by consent :
(i) The mandate of the Arbitrator earlier appointed stands terminated. (ii)Mr. Cyrus Bharucha, Advocate is appointed as the sole Arbitrator to decide the disputes between the parties arising out of the Share Holders Agreement dated 14-07-2014 and Appointment Letter dated 27-11-2014. (iii)The disclosure of Mr. Cyrus Bharucha, Advocate under Section 11 (8) read with Section 12 (1) of the Arbitration and Conciliation Act, 1996 is taken on record.
(iv)The parties shall appear before the learned Arbitrator in his chambers, ssp 1/2
carapl 164 of 2017.sxw on 15 th January, 2017 at 05.00 p.m. and obtain necessary directions. (v) The parties shall upto 14th January, 2017 make attempts to amicably resolve their disputes. Only if they fail to resolve their disputes amicably, they shall appear before the learned Arbitrator on 15th January, 2017. However, if they have settled their disputes prior to 15th January, 2017, they will inform the learned Arbitrator about the same.
(v) The venue of Arbitration shall be at Mumbai. (vi) The cost of arbitration shall initially be borne by the parties equally. (vii) All contentions of the parties are kept open. (viii)In view of this order, the above Arbitration Application is disposed of. ( S.J.KATHAWALLA, J. ) ssp 2/2
