This Chamber Summons is for amendment of the Suit. It proposes amendments by adding certain averments listed in Schedule I of the Affidavit in Support. These amendments are necessary for proper disposal of the Suit.

The Chamber Summons is made absolute in terms of prayer clause (a). Amendments to be carried out on or before 21st January 2017. A copy of the amended Plaint to be served on the Advocates for the Defendants on or before 27th January 2017. Additional Written Statement, if any, to be filed and served on or before 10th February 2017. The Suit will be then taken up on 13th February 2017 for marking of the documents and framing additional issues. 3.

Prayer clause (b) of the Chamber Summons is relief directed against the 1st Defendant to produce a Memorandum of Understanding ("MoU") dated 21st December 2010 (Mr. Khandeparkar does not press the more general latter part of this prayer). On instructions from the 1st Defendant, a statement is made that she does not have the MoU. This is noted. 4.
