Since the application for stay is pending before the Learned Debt Recovery Appellate Tribunal, we are not inclined to entertain the present petition.

The Learned Counsel for respondent no.1, states that, auction is scheduled on 3rd January, 2018. It could thus be seen that, it is more than a month period for

The petitioner can very well apply to the Debt Recovery Appellate Tribunal for taking up the said application prior to the date of auction.
