The Testamentary Petition No. 2310 of 2021 has been filed seeking Letters of Administration in respect of properties and credits of one Mr. Ramon James Menezes (the deceased).

The Petitioner namely Lynette Ramon Menezes has since also passed away and it is thus for the present Application has been filed to bring on record the legal heirs of the deceased Petitioner.

I have heard learned Counsel for the Applicants and perused the copy of A.B.Kakde 1/2

I find that there is no impediment in permitting the present Application. The Interim Application is therefore allowed in terms of prayer Clause (a), (b) and (c) which read as under:

"a) The delay in filling the present Application of 37 days be condoned; b) This Hon'ble Court be pleased to allow Applicantls to delet the name of Original Petitioner i.e. Lynette Ramon Menezes, on account of her death.

c) This Hon'ble Court be pleased to allow Applicants to carry out all necessary amendment in the cause title of Testamentary Petition NO. 2310 of 2021 by adding/substituting their names as the Legal heirs of the Original petitioner and to do all consequential amendment in the said Testamentary Petition as per the Schedule at Exhibit C." 5.
