Leave to amend is granted to delete the name of the respondent no.2 from the cause title of the notice of motion. Amendment to be carried out within one week from today. Re-verification is dispensed with.

By this notice of motion, the applicant seeks condonation of delay of 10 days in filing the arbitration petition. 3.

I have heard the learned senior counsel for the applicant and the learned counsel for the respondent no.1. I have perused the averments made in affidavit in support of the notice of motion. No affidavit-in-reply is filed.

In my view, the applicant has sufficiently explained the delay in filing the arbitration petition. For the reasons recorded in the

ppn 2 908.nms-1892.17.doc affidavit in support of the affidavit in support of the notice of motion, delay of 10 days for filing the arbitration petition is condoned. Notice of motion is made absolute in terms of prayer clause (a). No order as to costs.
