Mr.Pradeep Rajgopal with Ms.Rekha Rajgopal for the Petitioner. Mr.O.A. Das for Respondent No.1.
Mr.Makrand Kale i/b M.P. Vashi & Associates for Respondent No.2. CORAM : R.D. DHANUKA, J.
DATE : 25TH JUNE, 2015.
P.C. :- 1.
By this appeal filed under section 37 of the Arbitration & Conciliation Act, 1996, the petitioner has impugned an order dated 12th March, 2014 passed by the arbitral tribunal granting various interim reliefs against the petitioner. A perusal of the order clearly indicates that the learned arbitrator had proposed to record the reasons separately for the said order dated 12th March, 2014. It is not in dispute that no such reasons are rendered by the arbitral tribunal in support of the said order dated 12th March, 2014 at any point of time till date.
2.
Learned counsel for respondent no.2 states that the 1/2
arbp254-15 arbitral tribunal has already rendered final award. 3.
In my view since the impugned order is without rendering any reasons, such order cannot be sustained. The impugned order dated 12th March, 2014 is accordingly set aside. The petition is allowed. No order as to costs.
