---- CORAM : K.R.SHRIRAM,J DATE : 23.12.2015 P.C.:- The application is for leave under Section 446 of the Companies Act 1956 to join Official Liquidator, High Court, Mumbai of the respondent-company in liquidation as a party defendant to the C.S. (O.S) No.2127 of 2009 filed by the applicant in the High Court of New Delhi.

I have considered the affidavit in support and also heard the counsel. In my view, the application has to be allowed. The application therefore, is allowed in terms of prayer clause-(a) which reads as under :- "(a) that this Hon'ble Court be pleased to pass an Order granting Leave to the Applicants to join Official

Liquidator, High Court, Mumbai of the Respondent Company, in Liquidation as a party Defendant to the C.S. (O.S.) No.2127 of 2009 filed by the Applicant before the Hon'ble High Court, New Delhi."

Application, accordingly, stands disposed.
