The learned counsel for the Mumbai Municipal Corporation on instructions of Shri Shriram Manjrekar, the Senior Inspector (Licence), K/W ward states that the the order of the Second Appellate Authority dated 7th October 2015 has been withdrawn and that the appeal will be heard afresh.

We accept the said statements. Hence, we dispose of the petition by passing the following order:

(i)We direct the petitioner to appear before the Second Appellate Authority on 26th October 2015 at

oswpl2944 11.00 a.m. On that date, the schedule of hearing of the appeal shall be fixed;

(ii) The appeal shall be decided as expeditiously as possible and in any event on or before 31st December 2015;

(iii) All contentions on merits of the appeal are kept open;

(iv) Writ petition is disposed of on above terms;

(v) All concerned to act upon an authenticated copy of this order.
