We find that the petitioner attempts to obtain the decision on his application moved on 14/7/2015 for claiming eligibility as slum dweller. Learned counsel submits that application has remained pending though period of three years has expired. He also points out that in the meanwhile, the authority who has to take the decision on that application has been changed and now it is Deputy Chief Executive Officer MHADA who is designated as competent authority.

During the hearing, we find that there is communication dated 24/1/2018 sent by the Deputy Registrar (ENC/REMO) and competent authority to respondent no. 2 on record in this respect.

As a mandamus is sought, we grant the petitioner leave to make appropriate representation for expeditious consideration of said application. If such representation is moved by the petitioner before the competent authority within one week from today, the competent authority shall decide it in accordance with law within next four weeks. Keeping all rival contentions open and with these directions, we dispose of the writ petition.
