Perused the above Application and the Affidavit in support thereto. The Petitioner is the Secured Creditor of Sundeep Polymers Pvt. Ltd. (company in liquidation). In view thereof, the Application is allowed in terms of prayer clause (a), which is reproduced hereunder : "(a) that this Hon'ble Court be pleased to grant leave to the Applicant Company under Section 446 of the Companies Act, 1956 to continue the Suit No. 3972 of 2000 filed by the Applicant in this Hon'ble Court against Sundeep Polymers

Nitin 2 / 2 978-CA-41-2015 Private Limited (in liquidation) and to that end to join the Respondent, being the Official Liquidator, High Court, Bombay in his capacity as the Liquidator of Sundeep Polymers Private Limited as a party defendant in the Suit filed by the Applicant being Suit No. 3972 of 2000".
