The matter was argued on 12.01.2016 and remained part-heard as the counsel for the company wanted to take instructions to check if his clients are ready and willing to amicably resolve the matter. Today, both the counsel for the petitioner and the counsel for the respondent state that they are settling the matter and the order, by consent, be passed. Therefore, the consent order is as under : (i) Pursuant to an order dated 2.12.2014, a company has deposited a sum of Rs.23 lakhs with the Prothonotary and Senior Master, High Court, Bombay. (ii) The Prothonotary and Senior Master, High Shraddha Talekar PA 1/2

906.cp.96.2013.doc Court, Bombay to foreclose the fixed deposit and from the amount realized, pay a sum of Rs.20,47,391/- with proportionate accrued interest to the petitioner and the balance amount to be paid over to the company. The petition accordingly stands disposed.
