Though respondents are duly served, no one appeared on behalf of them when the matter was called out for hearing. Advocate for the applicant undertakes to file affidavit of service within one week from today. Same is accepted.

This application is for fixing early date of hearing of Writ Petition No.1259 of 2009 on the ground that applicants are senior citizen.

The learned counsel for the applicant relies on documents at Exhibit- A1 to A3 to show that the applicants are Senior Citizens.

22 nmw38-17 Considering the submissions made by the learned counsel for the Applicant and the averments made in the affidavit in support of Notice of Motion, I am satisfied that the Applicant has made out a case for allowing the present Notice of Motion. Hence, following order:

a) Hearing of Writ Petition No.1259 of 2009 is expedited in the list of Senior Citizen.

b) Office is directed to place the matter for final hearing in the weekly board as per its turn in the list of Senior Citizen.

c) Notice of Motion stands disposed of accordingly.
