In view of the assertions in affidavit in support in particular, averments made in paragraph 2, a case for restoration is made out. Accordingly, Notice of Motion is made absolute in terms of prayer clauses (a) and (b), subject to the condition that the Applicant will remove all office objections in Appeal within a period of three weeks from today.
