Heard the learned counsel appearing for the applicant. The appeal preferred by the applicant has been dismissed for non-removal of office objections by the Prothonotary and Senior Master in exercise of powers under Rule 986 of the Bombay High Court (Original Side) Rules. In view of the averments made in the affidavit in support and in particular, paragraphs 5 and 6, a case for restoration is made out. Accordingly, notice of motion is made absolute in terms of prayer clause (a) subject to condition of appellant removing all office objections and getting the appeal numbered within a period of one month. If compliance is not made by removing office objections within the stipulated time, the appeal shall stand dismissed for non-prosecution without further reference to the Court. (M.S. SANKLECHA, J.)
