The learned Advocate appearing for the Petitioner on instructions state that the above Petition is filed on 10th November, 2017 by the Petitioner under Section 9 of the Arbitration and Conciliation Act, 1996 and the ad-interim order is obtained on 18th January, 2018. He further on instructions states that till date the Arbitration Agreement is not invoked. In view thereof, the above Petition is dismissed. 2.

The Court Receiver stands discharged without passing accounts but subject to payment of his cost, charges and expenses within a period of four weeks from today by the Petitioner.
