The respondent has filed an affidavit dated 6.7.2017 and in Para 6 of the said affidavit it is stated that the respondent has also filed an application under Section 10 of the Insolvency and Bankruptcy Code, 2016 before the National Company Law Tribunal Ahmedabad and the said matter is subjudiced. In view of the affidavit filed by the respondent the learned counsel for the petitioner seeks leave to withdraw the petition with liberty to file a fresh petition or appropriate proceedings after the proceedings before the NCLT are over or the order passed by the NCLT is vacated.

Leave granted.

Petition is disposed off as withdrawn.
