This notice of motion is taken out by the original Defendant seeking condonation of delay of six days in entering appearance after receipt of the writ of summons in the commercial suit filed under Order 37 of the CPC. For the reasons stated in the affidavit in support of the notice of motion, the notice of motion is made absolute by condoning the delay and permitting the Defendant to enter appearance in the commercial suit. Appearance shall be entered within a period of one week from today. Considering the possibility of settlement, the commercial suit shall appear on board for directions on 29 January 2018.
