By the above Review Petitions, the review is sought of the order dated 13-10-2106 passed by this Court in the above Writ Petitions. The review is sought on the ground that though in terms of the said order the Petitioners have vacated the structures, the developer i.e. the Respondent No.4 herein has not entered into agreements in respect of the permanent alternate accommodation as also has not paid transit rent to some of the Petitioners. The above Review Petitions have come up for hearing on two earlier dates when a statement came to be made on behalf of the Respondent No.4 that the mmj
rpw-59&60-16-(901) Respondent No.4 was always ready and willing to execute the agreement as also always ready and willing to pay the transit rent. However, in so far as the transit rent is concerned, the procedure is required to be followed to directly transfer the amount from the account which is in the name of the society to the account of the individual occupant.
Today when the above Review Petitions are called out, this court is informed that the agreements have been entered into in respect of the Review Petitioners in the intervening period as also the transit rent has been credited to the accounts of all the Petitioners except two Petitioners i.e. Petitioner No.6 (in Review Petition No.59 of 2016) and Petitioner No.10 (in Review Petition No.60 of 2016). The Learned Counsel Mr. Mistry appearing for the Respondent No.4 states that the process of transferring the transit rent would be completed latest by 2-2-2017. In view of the said statement, it is not necessary to keep the above Review Petitions pending. The Review Petitions are accordingly disposed of.
In Review Petition No.59 of 2016, the Review Petitioners who have filed the applications for being declared eligible, their applications are directed to be disposed of expeditiously by the concerned Competent Authority.
