Therefore, suit is dismissed as against defendant nos.2 and 3 as withdrawn.

The consent terms signed by the constituted attorney of the plaintiffs, defendant no.1 and their respective advocates is taken on record and marked 'X' for identification. Mr. Shiralkar and Mr. Mudnaney state that constituted attorney of the plaintiffs and defendant no.1 are present in court.
