The learned Senior Counsel Mr. Prasad Dhakephalkar submits that he may be allowed to intervene in the present matter on behalf of Chief Promoter of Jaihind Gandhinagar CHS through Sayyad Vazir Bashir.

The learned Counsel for the petitioner has no objection to allow them to intervene in the present petition without admitting their locus standi. By this petition under Article 226 of the Sneha Chavan 1/2

PR 904 wpl 3109-16.doc Constitution of India, petitioner is challenging the order dated 24.10.2016 passed by the Respondent No.1.

The learned Senior Counsel for the Respondent No.4 as well as learned Senior Counsel for the intervenor and learned Counsel for the Respondent Nos. 1 and 2 raised preliminary objection about the maintainability of Writ Petition. They submit that alternate remedy is available to the petitioner to move before High Power Committee. At this stage, the learned Counsel for the petitioner seeks permission to withdraw the present petition with liberty to move before High Power Committee. To that effect, he has given in writing on Farad. Same is taken on record and marked 'X' for its identification.

Writ Petition stands disposed of as withdrawn with liberty as prayed.

No order as to costs.
