Present:

Mr. Manoj Agre i/b Mr. G.B. Kedia, Advocate for the Judgment Creditor. To-day, the matter is kept for directions/dismissal under Rule 52D of Bombay Insolvency Rules, 1910.

As per Order dated 31st July, 2018, the Judgment Creditor was directed to serve the Insolvency Notice by substituted mode of services i.e. (i) by way of affixing copy of Insolvency Notice upon the residential premises of the Judgment Debtors, (ii) by way of Registered Post A.D. and (iii) by way of affixing the Insolvency Notice on the Notice Board of Insolvency Registrar. Accordingly, on 25th September, 2018 one week's time granted to file Affidavit of service about the service of Insolvency Notice by R.P.A.D. upon the Judgment Debtors.

The Ld. Advocate for the Judgment Creditor filed the Affidavit of Service dated 26th September, 2018 with the Registry on 1st October, 2018. The same is taken on record.

As per the service report prepared by the Registry dated 3rd October, 2018, upon the Affidavit of Service dated 26th September, 2018, it is put on the record that Insolvency Notice No.5 of 2018 is duly served upon the Judgment Debtors. PER INSOLVENCY REGISTRAR:- In view thereof, the purpose of Insolvency Notice is fulfilled, hence removed from the Board.
