The learned Advocate for the Defendant states on instructions that pending the hearing and final disposal of the Suit, the Defendant shall not dispose of, sell, alienate, part with possession and/or create third party rights in respect of the suit premises being 41-B and 42-B of Mittal Court, Nariman Point, Mumbai. The statement is accepted. In view of this statement and further in view of the fact that the trial in the above Suit has already commenced, prayer clauses (a) and (c) of the Notice of Motion are not pressed on behalf of the Plaintiff. The Notice of Motion is accordingly disposed of.
