The Petition is for leave under Clause XII of the Letters Patent. The suit is for partition of some HUF properties. While the Plaintiffs and Defendants are within the jurisdiction of this Court, some of the properties are outside the jurisdiction of this Court. This is not a suit for land within the meaning of Clause XII of the Letters Patent. A material part of the cause of action has arisen within the jurisdiction of this Court. I am satisfied that with leave granted under Clause XII of the Letters Patent, this Court will have the jurisdiction to entertain and try the suit. 22nd October 2018
