By this petition under Articles 226 & 227 of the Constitution of India the Petitioner challenges the order dated 05.04.2016 passed by the Competent Authority-II, Mhada, Mumbai in Case No. 5 of 2015 rejecting the petitioner's application for framing preliminary issues.

There is alternate efficacious remedy is available under Section 70 of The Maharashtra Housing & Area Development Act, 1976.

In view of this fact, petition stands disposed of with liberty to the petitioner to prefer appropriate Appeal, if they so desire.
